So here we are, it's been over a year since the auto accident. I have pushing $100k in bills from it all. Last settlement offer was $2,000 and now they are offering $3,000. What a joke.

My attorney called today to let me know, as he has to by law. Then he tells me that well, the specialists aren't sending back the paperwork he needs from them, and the paperwork he has gotten, no one will say Yes, my "hurts" , Fibro, CFS, CPS, IBS, PTSD, etc, etc, are resulted from the accident. And without a Dr stating it is, we have little case, if any. The devil you say?!?! I know I did!! Dumb Doctors! Yes, they all tell ME that, but won't put it in writing!

The attorney even told me that the FNP I was seeing who I always liked very much, but because she's only a FNP her comments can't be used, wrote something bad about me. I was like HUH?!??! She's always so nice, firnedly, etc. Well, it seems after the new Doctor came to the clinic (the one who told me I am fat, lazy and she doesn't believe in pain meds and took me cold turkey off them) we had a bit of disagreement and I turned the Docotr in. Not only to her Director over the offices, but also to my Psychologist in Springfield. It was soon after that the the FNP put a note in my file that the reason I have trouble with my joints, back, neck, etc is because I'm so grossly obese and have very poor posture and won't listen to them!!!!! EXCUSE ME?!?!?! "I" am the one who complained from the beginning when I saw I gained 20 pounds after being put on meds as a guinnea pig. I've complained for the past year. I have not changed my diet. I eat as little as I always have which my DH says isn't enough to keep a bird alive. I haven't done anything differently to cause weight gain, but I've gained over 70 pounds. The Doctors NEVER bring up my weight. "I" ALWAYS bring up my weight. I'm SOOOOO uncomfortable. But that witch (being nice here) had the odasity to put on there that "I" won't listen, and have poor posture and am grossly obese. That hurt!! When I'm weighted they always look at me, and look at the scale and can't understand 'where I'm hiding it all'. I told my Doc on this last visit, I am now wearing my sons clothes (the handicapped one since he needs larger on account of diapers, etc), and can't afford to buy clothes, I can't afford to gain any more weight, PLEASE....HELP ME!!!! So, he gave me a paper packet on a diabetic diet (no, I'm not diabetic) to follow.

But here we are, this far out and the attorney sounds like he's wanting to throw in the towel. I didn't give him a chance, I asked if he heard from this one or that one or my surgeon. Well, lucky for me, he knows my surgeon as he also did surgery on my Lawyers wife. So he will contact him personally and try to get something, but still says the Fibro, CPS, CFS, PTSD, IBS-C, etc won't be admissable in court for settlement. I'm like what the.....???? THOSE are now my major issues. They are also what takes the majority of our income in buying meds for. I didn't have this before the accident. I wasn't 'sickly' before the accident.

I just don't know now how to prove for the courts that yes, all this IS from the accident. And if I can't prove it, $99,000 of that $100,000 we have in medical is not able to be turned in!

I'm so beside myself.

Then while on the phone with them the Doc's office called. They got my blood work back it is:

Triglycerides (should be 0-179) mine is 531

Cholesterol (should be 100-200) mine is 237

So effective immediately I am to stop all red meat, all fried food, all sweets, preferably caffiene. Eat lots more fruits and vegetables. I love vegetables and fruits, but DH won't eat them. So, for supper I pattied burgers for the guys and I fixed salad while DH cooked them. I had salad, DH had burger and chips, and son had burger and salad. I guess it will be Mabel's Kitchen....what's your order, special for each person! lol

Please, pray for me and my lawyer and the case. I'm drowning figuratively and literally!!

Insurance companies can be hard. I am assuming since there is a settlement offer that the accident was not your fault. The offer is ridulous. Although it is hard to prove to the insurance companies that this is all something new, especially if you have a history of any of it in your past. I know this because I went through this with my accident. I had experienced a few migraine headaches during my 42 years so they thought they should not have to deal with the fact that I live with one every day now. It also took alot of convincing to get them to pay my psych bills. I told them I never had any psych bills when I was a nurse working and making 65 thousand dollars a year.

Do you have any insurance on yourself in case of an accident. I carried 100,000 , 100,000 , and 300,000. Which means I carried one hundred thousand on me and my passenger and three hundred thousand on the person I might be involved in an accident with. This is exactly what the person that hit me ended up having on me. This meant that the most I could get from the accient was 100,000. Of course you don't know this until after you settle. Unfortunately, I lost my nursing career. My husband and I figured it out and it was aroung one million 4 hundred thousand dollars without any overtime. That is a far cry from 100,000 dollars. Then the lawyer took his third and I had to pay back disability where I work because you cannot make more than you would have working and the settlement was considered a paycheck. They wanted 28 thousand and my lawyer got them to settle for 15 thousand and I owed my dad 10 thousand and my kids school 12 thousand. So I didn't have much left.

My insurance is still paying my medical bills and my prescriptions until January. Then I don't know what we will do. As far as the weight thing. Part of the reason I lost my disability hearing was because the judge felt I couldn't have facial pain or be depressed because I have gained weight. They have no clue. I diet too and it is almost impossible to lose weight. I think alot of it is fluid. My cholesterol and trigyecerides are up too. I think mine is family history and lack of exercise more than diet, but I am working on that too. I used to work for a doctor that was very diet conscious and he encouraged me to use Smart start butter (i think that is it). It is not bad.

Finally, the way my case closed is I hounded my lawyer to get it done. They offered me a ridiculous offer too. I then wrote them a letter telling them what my counter offer was. For my carreer and pain and suffering and my husbands pain and suffering and time off from work and having to be both mom and dad. It was something like one million five hundred thousand dollars. They settled within the month. I got the maximum she had. 100,000 dollars. It sucks. I couldn't sue anything that had both her and her husbands name on it because only she was in the car at the time of the accident and that is the law in Maryland.

WE will never recover financially. We filed bankrupcy, lost my car, and are now filing for government assistance because of being turned down for SSD which is under appeal. Get your doctors to send the information. You may need to call. Explain that it is holding up your case. Then take it to your lawyers. Make you lawyers get off their butts and help you. They took your case. Now they can do the work. I hope this helps you.

Thank you both. No we don't have medical coverage, we did have 100/100/300 on the truck as well. And under insured and no insured. Mine won't pay because its in litigation, her's is just stupid.

I don't have any past history of any of this except when I went through my horrible divorce I had migraines from stress and had to go once for a migraine shot.

I've started going to the ppa site and getting help on my prescriptions like that. Some I pay a fee for, like my gabapentin is $20 a month, some are no cost, which really helps out.

I never had anything like this before the accident, and nothing like this runs in the family, so they couldn't say it was genetics.

We had to sell off both cars to pay off the medical on the credit cards, and now here we are 9 months later and the credit cards are maxed again with medical. and we drive a crappy vehicle that I can hardly reach the pedals.

I too was denied on my SSD and have a lawyer now on that. It's sad tho that Society gives them such a big cut on everything which leaves us doing all the fight and getting next to nil by the time everyone is paid!

Thanks for your information and everyone's prayers. They are so appreciated. TOday I got up and my attitude is"When you are at the bottom of the barrel, there is no place left to go but up!" So I'm looking forward to going up!!

I don't know if insurance changes in states and I live in Maryland, but mine was in litigation for almost two years. My insurance paid my medical the whole time and is continuing to. It will do so until three years to the date of the accident. I pay for my meds, mail them the receipt and they mail me a check.

As for the migraines, that you will have to fight both in your litigation and your fight with SSD. It has been the one thing that SSD has not been able to explain away in my hearing. I know your money is tight, but if you have a migraine, go to the ER! I got penalized for not going to the ED and clinics enough for my migraines at my SSD hearing.

I am trying to call my dad who has worked in insurance for 45 years to see if he can help you, but the line has been busy. I will talk to him and ask him why no one is helping you. I hope I will have some answers for you. If I do I will PM you.
