Hey guys... I'm on your side - but speaking from the law - I'm doing some research and I don't there there are laws protecting your right to go to a funeral. You can't be fired while on sick leave - however - I don't think going to a funeral is protected.... although it should be. You should be able to file for workman's comp however. I'd take them for all their worth!!!

That is ashame. It just doesnt seem right to be penalized for going to a funeral.
I have dystonia, neuropathy, gerd, arthritis, and fibromyalgia, carpal tunnel and other ailments. I enjoy embroidery,music, and reading my Bible and Christian books. I love to bake. I try to be very supportive and positive.

Thank you all sooo much for the support. It means a lot that I have people in my corner! My biggest problem was dealing with a boss and people that I worked with that thought that since I looked fine that I was fine. Of course we all know that is not true! The day it happened I was just absolutely heartbroken about the whole thing. I did think that my boss had more respect for me than that...obviously not. Now, I have realized that I am definately better off without that job, thanks to the support of you all and my wonderful family. I don't know the law, but it does seem ridiculous that someone could fire you for your illness or for a funeral. Because I definately made it abundantly clear that I had Fibro when I was hired. I even can understand the fact of wanting to let me go to find someone who could be there all the time, but there is no excuse for his timing! Thanks again everyone for all your support!!

Sweetie...

You have rights. Whether you want to go back to work or not. Legally you have 2 (or 3...FOG) work days to be gone for a family death. BUT...they get you by making it so it has to be an 'Immediate Family Member', and I've been there...Grandparents aren't included. I'm sure you could fight it...but for what?

Do you really want to go back to work for someone who would do that to you in the first place? I know what I'd say and do...but that's me!

As far as being fired for the 'sickness'...you legally have soo many sick days. Different companies are different, but I do believe the state makes the final call and sets the final number of days. I'm not sure what that is...but I'd be happy to find out for you if you want to and/or are going to fight this.

Given what happened to me at my job- it was a good job with good benefits but in my opinion no job is worth your health. Believe me you don't want to work for someone who dismisses the fact you have a chronic condition. I thought about legal action against my previous employer but "Do I really want to work there with the stress?"- no way.

They knew I had fibro too- when they hired me I was told "We want to make this job work for you"- because I had alot of experience.

I came to find out they didn't keep their word- so as much as I hate to say it- just because an employer KNOWS you have fibro and seems to accept the challenges you are dealing with- don't bank on them keeping their word.

I was so hurt and angry over this- but "it is what it is"- Now that I am not working I definately have an improvement in my symptoms and am not even taking as much medication.

Maybe we should start walking around with canes and back braces- even if we don't need them. Let's look more ill so they realize "this person really has something wrong with them" LOL- ok- let's not but it is funny to think about it!

I am not going to fight it...I never want to work at that place again and it is not worth it. I am just going to move on to some better things. I started a support group in TN and so by not working now it will give me more time to focus on that, since our 1st meeting is in 2weeks. Also, wil give me a chance to really get over this flare up. And since I moved back in with my parents they can help me out til I find a new job. I am just worried that he will say that I am unreliable because of my fibro if someone ever calls him for a reference. It's just a bad situation all around. Thank you also for the thoughts and prayers about the loss of my Grandfather. He was a very special man!

I'm concerned about that as well- but from what I heard- the law no prohibits them from saying that kind of stuff- who know though.

I don't have them down as a reference- just a previous employer. I think I read the only question potential new employers might ask is "Would you hire this person again?"- I worry about that one myself.

Just make sure you have good references down for them to contact- basically that is all we can do.-m

I don't think legally you can be fired for having fibromyalgia and going to a funeral,i am sorry to hear about your grandparents
