When I stumbled across MD Junction, and met others who had the same disease I was not alone in battling the disease. Randy I have to agree with Bonnie if it even looks like you can do it they will deny you. In my hearing which took two years I did not apply for cirrhosis I applied for fybromyalgia and that is a real hard one because there is no tests to confirm that. I simply told them what I could and could not do the real problem was not the fibro it was the cirrhosis I did not know I had in the end it came to light and all it took was a fax of my biopsy after the hearing and two weeks later I was awarded. If you are not happy with your attorney there are so many but make sure it is a social security attorney as they specialize in this you will get eventually. Good Luck! Cheryl

Hi Randy,

My husband was denied three times before he was approved. The bottomline is there are not enough resources to go around so they deny everyone the first time in hopes that you'll give up and go away. If you keep on them they will give up on denials and give it to you to make you go away so they can move on to denying others. If all else fails, ask to speak to their supervisors and hire an attorney. Take care and don't take it personally.

Well denial letter number 2 recieved today. They took less than a month to decide this time around. The process was to just to fast for me even to see a psychiatrist and also a nuerologist to provide more evidence. The first appointment 08/24 and the other will be 09/22.

Up next will be the hearing. I sure am getting very frustrated, I would have expected a lot better direction from this lawyer! I guess they are just there as experts on filing the paperwork. For the hearing portion this will be the first of any partisipation from the actual attorney. All other efforts have been made by his ASS.

I wonder has anyone else's lawyers office handled this in the same manner?

yes my lawyer did the same thing. I didn't even see him till 1 week before my hearing for him to tell me what to expect and go through a mock type hearing. then on the day of the hearing it was done by video conference with the judge because in my area the closest judge was 3 hours away. anyway I was in there for about 15 mins and 3 weeks later I received a letter saying I won my disability. what helped me was all the symptoms from my meds the fatigue the very loose stools from the lactulose I am taking ect. so hang in there you are so close to winning your case now

Approved! I went to the mail box and found a letter from SSI. They had an appointment scheduled for me to come apply. I knew my wifes income was to much since at the begining of this all my lawyer had me apply since it was part of the process. It said nothing about approval. I called my lawyer and asked what it meant and she said she thought it meant the cancelled at the hearing level and approved me. She then made a phone call on my behalf and its true! I was doing the happy dance! ha ha Then just two days later I got the offical letter! 8 1/2 months is what it took to go from the a begining to the end. 2 denials and begining of the hearing level.

I strongly reccommed for anyone applying to obtain a lawyer. It is free until your approval at which point the can take up to 6% of your back pay. Does anyone know how long it takes to recieve back pay and first check?

back pay will be paid from the time beginning the sixth month after the date they found you to be disabled. That is not the date the approved your disability. If you just got the letter, I would expect you to begin receiving around the second week of January, as long as that is 6 months from disability date.

They agreed to go back as far as Jan. 09. I was told at SSI that my first check will probably come in the mail. I plan to go away for the holidays and worry about it being left in the mail box. I think I can ask the post office to hold my mail? Maybe that would be the way to do it? Thanks Mike and Paul.

Oh and congradulations Mike, I know you will be a very good group leader!
