You are a qualified individual for this credit if you are a US citizen, (it applies to over 65 and under 65 but I am only posting the under 65 rules) you were under the age of 65 at the end of 2008 and all three of the following statements are true. 1. You retired on permanent and total disability. 2. You received taxable disability income for 2008. 3. On January 1, 2008 you had not reached mandatory retirement age. Permanent and total disability is if you cannot engage in any substantial gainful activity. A physician must certify that the condition has lasted or can be expected to last continuously for 12 months. So, your answer is no. You have to have the disability income.
