I asked this in the Tax Time thread and no one has yet to answer.

Can I file myself as disabled if I don't receive disability yet?

450 mg Wellbutrin
50 mg Thorazine (titrating down 25 a month)
200 mg Lamictal
60 mg Adderall
25 mcg Cytomel

I believe you have to be on SSD to file yourself as disabled but that is just my opinion. Call HRblock they will answer questions like that even if they aren't doing your taxes.

I used to work for H&R Block. I am looking at publication 17 right now to get you the answer. This publication is general line by line answers to your questions.

K, here is what I found. You are a qualified individual for this credit if you are a US citizen, (it applies to over 65 and under 65 but I am only posting the under 65 rules) you were under the age of 65 at the end of 2008 and all three of the following statements are true.

1. You retired on permanent and total disability.

2. You received taxable disability income for 2008.

3. On January 1, 2008 you had not reached mandatory retirement age.

Permanent and total disability is if you cannot engage in any substantial gainful activity. A physician must certify that the condition has lasted or can be expected to last continuously for 12 months.

So, your answer is no. You have to have the disability income. You can go to the IRS website and download pub 17. The answer to your question is on pages 225 and 226.
